ABOUT AFIQ

AFIQ pursued his legal studies at MARA Technological University and was officially called to the Malaysian Bar in January 2022. During his pupillage, he gained diverse experience across various levels of the Malaysian court system, laying a strong foundation for his entry into the legal profession with notable ambition. Currently in his second year as a legal associate, Afiq is a dedicated professional assisting the partners of the firm.

His primary area of practice lies in civil litigation, where he adeptly handles contractual disputes, debt recovery, and company and commercial litigation. Additionally, Afiq provides valuable advice on matters related to commercial crime and tortious disputes.

Beyond the legal realm, Afiq is a person of diverse interests. Whether it’s sports, film, music, or poetry, he finds inspiration in various forms of art, considering them a necessity of life. Fluent in both English and Malay, Afiq is also on a journey to learn sign language, demonstrating his commitment to effective communication and inclusivity. With his multifaceted interests and professional dedication, Afiq embodies a well-rounded and forward-thinking legal associate within the firm.

SIGNIFICANT PIECES OF WORK

  • 1. Civil Procedure

    Drafted an Application to Intervene in a proceeding after final judgment had been delivered. Application was allowed by raising an interesting and recent point of law embedded in Dr Lourdes Dava Raj v Dr Milton Lum Siew Wah [2020] 5 MLJ 185 which stipulates that although the general rule is that no application to intervene is allowed after final judgment had been delivered, it is permissible and worth considering that if the applicant’s rights under natural justice is affected and that the applicant has equitable interests in the matter.

  • 2. Civil and Company Law

    Assisted in a case of personal action to impeach an illegal Consent Judgment. The client was a majority shareholder in a company and when the company was wound up, all the assets were dissipated and the liquidator entered into a Consent Judgment contrary to the provisions of the law. Was central in defending against three (3) appeals in respect of Striking Out applications, defended against Preliminary Objections prior trial as well as defended against another Striking Out application, which all have been dismissed.

  • 3. Contract Law

    Handled a matter to recover outstanding sums amounting to RM890,000.00 for non-payment of delivery and supply of construction materials. Drafted and pursued a Summary Judgment application as well as defended against a Striking Out application by the other party.

  • 4. Land Law

    Client was the legal registered owner of a house, which the tenant refused to move out and forged documents to fraudulently misrepresent oneself as the registered owner of the house. Assisted the client in obtaining a Vacant Possession order against the tenant.

  • 5. Arbitration

    Co-wrote an article in respect of the Nature & Role of Emergency Arbitrators in Asian countries. Legal and procedural comparisons were discussed and published for legal-based audience.
